2. Purpose

The purpose of this document is to regulate the General Terms of Contract for the Online Booking Services (hereinafter the "Services") offered by ALBERGUE LA HUERTICA on its website (hereinafter, the "Web Site").

In this document, the terms "You", "Client" and "User" are used to refer to all those individuals and / or entities that access to the Web Site or use the Services offered on the Web Site.

The use of the Services by the User will imply the full and unreserved acceptance, and validity, of each and every one of the General Terms contained in the most updated version of this General Terms of Contract document. The General Terms listed in this document will be considered as automatically included in the contract subscribed with ALBERGUE LA HUERTICA, without the need for a written transcription of said General Terms in the contract.

3. Uso of the Online Booking Services

3.1. Online Booking Services

3.1.1. Purpose

The purpose of the online booking Services is to book, through the Web Site, one or more beds and / or breakfasts at ALBERGUE LA HUERTICA.

3.1.2. Confirmation and Check-in Instructions

After making his booking, the User will receive an email confirming the booking, which will also give instructions on how to carry out the check-in process at ALBERGUE LA HUERTICA. This e-mail confirming the booking will serve the User as proof of the booking. The holder of the bank card or PayPal account used (depending on the payment method selected by the User) for making the booking must correspond to the guest who will stay at ALBERGUE LA HUERTICA (or to one of them in case there was more than one guest included in the booking).

3.1.3. Check-in Conditions

The entry start time for all bookings will be 16:00 (local time) on the day of the start of the contracted stay.

The entry deadline time for all bookings will be 24:00 (local time) on the day of the start of the contracted stay.

3.1.4. Check-out Conditions

The check-out deadline time for all bookings will be 12:00 noon (local time) on the last day of the contracted stay.

The Client must notify the reception staff of ALBERGUE LA HUERTICA (if there are such personnel) of his departure from the facilities. If there is no ALBERGUE LA HUERTICA reception staff at the time of the check-out of the Client, he may leave the ALBERGUE LA HUERTICA facilities without notification to said staff.

3.1.5. Cancellation of Bookings

The Client can cancel an online booking by contacting ALBERGUE LA HUERTICA only through e-mail at the address "info@hostellahuertica.com". Cancellations of bookings by any other means are not accepted. In case of cancellation, ALBERGUE LA HUERTICA will reimburse the Client for the total amount of his booking as long as such cancellation is made at least 72 hours before the entry start time of the day of the start of the contracted stay. In the event that the cancellation occurs within 72 hours prior to the entry start time of the day of the start of the contracted stay, ALBERGUE LA HUERTICA will reimburse the Client only 50% of the total amount of his booking. In the event that, without prior notice, the Client does not appear at ALBERGUE LA HUERTICA on the first day of the contracted stay, ALBERGUE LA HUERTICA will cancel the reservation and will not refund the Client for any amount. The Client expressly authorizes that refunds due to cancellations are made to the bank card or PayPal account (depending on the payment method selected by the Client) that he used to make the booking.

3.1.6. Policy on Minors

Policy on minors: all people under 18 years of age can stay at ALBERGUE LA HUERTICA only if they are accompanied by their parents, legal guardians or other adults duly authorized by legal guardians. The staff of ALBERGUE LA HUERTICA may require to parents, to legal guardians, or to adults duly authorized by the legal guardians, to identify themselves as such with the relevant documentation.

3.1.7. Prices

The validity of the prices indicated on the Web Site will be limited to the terms indicated on the Web Site itself. ALBERGUE LA HUERTICA reserves the right to modify these prices without prior notice when there are reasons that justify it.

The prices will be indicated during the online booking. These prices will include VAT, notwithstanding that additional taxes may also be applied in accordance with current regulations. The VAT applied to the prices during the online booking will be in accordance with the tax rate applicable at the time.

If the tax rate varies on the date of delivery of the Services with respect to that in force on the date of making the booking, the tax rate that will be applied to the final price will be the one established at the time of delivery of the Services or the accumulation of the tax, even in the cases in which this caused an increase in relation to the final price indicated to the Client during the booking. In such cases of variation of tax rate, the collection or payment of the difference will be managed in person at ALBERGUE LA HUERTICA.

3.2. Use of the Services by the User According to the Law

The User is obliged not to use the Services in a way that contravenes the Law, morality, good customs, public order, as well as what is established in this document. Consequently, the User must not use the Services for illicit purposes or effects and / or contrary to the provisions of this document, and / or in any way that may damage the interests, the quality of the Services and / or the image of ALBERGUE LA HUERTICA or third parties.

3.3. Modifications in the Conditions of the Services

With the ultimate objective of benefiting the User, ALBERGUE LA HUERTICA reserves the right to unilaterally modify, at any time and without prior notice, the Services offered and the operational, technical and usage conditions of the Services. The User may make suggestions that he deems useful by contacting those responsible for the Web Site through the email address: info@hostellahuertica.com.

3.4. Payment in the Booking Process

During the booking process, the User will be indicated the total price to pay for the contracted Services.

3.5. Authorization of the User to ALBERGUE LA HUERTICA for the Collection of the Services

By accepting this document, the User expressly accepts that, when using the Online Booking Services, the User will automatically be charged to his bank card or PayPal account (depending on the selected payment method by the User himself) according to the contracted Services.

LBERGUE LA HUERTICA will keep the User's bank card details or PayPal account details with which the payment of the stay was made (depending on the payment method selected by the User himself) for the period necessary to ensure that the additional expenses that the User may have incurred during his stay are fully covered. As a result of this, ALBERGUE LA HUERTICA will temporarily store such data with the sole objective of being able to collect the additional expenses that the User has incurred during the stay and that have not been paid by him prior to the check-out. In the additional expenses, on top of all those expenses not contracted through the use of the online booking Services, those derived from damages that the User may have caused in the facilities of ALBERGUE LA HUERTICA due to an incorrect use are also included. By accepting this document, the User expressly authorizes that all the additional expenses that may be incurred during the stay be charged to the bank card or PayPal account with which the payment of the stay was made (depending on the payment method selected by the User himself).

Once ALBERGUE LA HUERTICA has verified that the User did not incur any additional expenses during his stay beyond those initially contracted and already paid, ALBERGUE LA HUERTICA will proceed to delete the data stored related to the bank card or PayPal account of the User. Therefore, in the event that the User contracted again the Services of ALBERGUE LA HUERTICA, he would have to provide his bank details again.

The User declares that he is the holder of the bank card (or the alternative means of payment used) that he provided during the payment of the Services and / or that the ownership of that bank card belongs to a third party who expressly authorized the User to use it.

3.6. Errors or Modifications in the Billing Information

If the User has provided erroneous data or if he wants to make changes on such provided data, he will have to contact "info@hostellahuertica.com" or the reception of HOSTEL LA HUERTICA to be able to correct the errors or make the requested changes.

3.7. Obligations and Responsibilities of the User Regarding the Use of the Services

3.7.1. Accuracy of the Data Provided by the User

The User agrees that all personal, billing or any other data provided to ALBERGUE LA HUERTICA are true, accurate, complete and up-to-date, answering for their veracity and undertaking to appropriately modify the information provided so that this information responds to the real situation of the User and that ALBERGUE LA HUERTICA can carry out the collections corresponding to such modifications. ALBERGUE LA HUERTICA is not responsible for the veracity of the data provided by the User in the web forms; It is the User who is responsible for the potential consequences and errors that may arise from the lack of veracity of the data.

3.7.2. Legal Actions in Case of Fraudulent Practices Committed by the User

ALBERGUE LA HUERTICA reserves the right to initiate the legal actions to which it is entitled by law in case of being able to prove that the User committed fraudulent practices in connection with the use of the bank card or other method of payment while contracting the Services.

4. Data Protection

4.1. Company information

The entity responsible for the treatment of the User's data in relation to the use of the Services is ALBERGUE LA HUERTICA. For more information regarding ALBERGUE LA HUERTICA, see section "1. Company information" of this document.

4.2. Consent

By accepting this document, the User is informed and gives his free, voluntary, informed, specific and unequivocal consent for the personal data that he provides through the Web Site to be processed by ALBERGUE LA HUERTICA, as well as the data derived from his browsing and other data that he might provide in the future to ALBERGUE LA HUERTICA.

Name, surname, nationality, e-mail, telephone, as well as data about products and Services, stay preference data, economic data, financial data, navigation data and other data provided by the User in the open fields.

2. Data provided by the User in the contact forms for inquiries:

Name, surname, e-mail, telephone and other data provided by the User in the open fields.

4.6. Legitimacy of the Treated Data of the User

ALBERGUE LA HUERTICA considers that the legitimacy for the treatment of the User's data will be given by:

1. For the entering, modification or cancellation of bookings: the execution of the contract between the parties. For the analysis of the use of the Web Site: the legitimate interest of ALBERGUE LA HUERTICA.

2. For sending contact forms for inquiries: the consent given by the User. For the analysis of the use of the Web Site: the legitimate interest of ALBERGUE LA HUERTICA.

4.7. Recipients with Which the Treated Data of the User will be Shared

7. Liabilities and Guarantees

ALBERGUE LA HUERTICA is not responsible if the information available on the Web Site is not exact, complete or current. The material on the Web Site is provided for general information only and should not be relied upon or used as the sole basis for decision-making without previously consulting more accurate, complete, or timely information. Any dependence on the material of this Web Site is at the risk of the User.

The Web Site may contain certain historical information. Historical information is not necessarily updated and is provided solely for the User's reference.

9. Acceptance of the Conditions of Use

By accepting this document of General Terms of Contract for the Online Booking Services, the User declares that he is aware that the use of the Services implies the total and unreserved acceptance of the Conditions of Use document in the published version by ALBERGUE LA HUERTICA on the Web Site at the precise moment in which the User contracts the Services. The Conditions of Use complete this document in everything that do not oppose the provisions set in this document. Consequently, the User will have to be aware of the importance of consulting the aforementioned Conditions of Use, prior to accessing and / or using the Services.

10. Applicable Law

These General Terms of Contract for the Online Booking Services and any separate agreement in which ALBERGUE LA HUERTICA provides Services to the User, will be governed and interpreted in accordance with the laws of the Kingdom of Spain.

The Client can present claims in the use of the Services by contacting ALBERGUE LA HUERTICA by email at "info@hostellahuertica.com".

This contract constitutes in a complete and integral way the agreement between ALBERGUE LA HUERTICA and the User, and replaces all those commitments, pacts, manifestations or agreements, written and / or oral, that would have existed previously between both parties.

The full text of these General Terms of Contract for the Online Booking Services, as well as the documents derived from it, have been originally written in the Spanish language. Although the versions published in other languages are considered official in the same way as the one published in the Spanish language, the Spanish language version is set as the reference for interpretation.

ALBERGUE LA HUERTICA is committed to seeking a friendly solution to hypothetical conflicts.
